TERMS OF PURCHASE
Ordering conditions
1. Scope and validity of the terms
1.1 The terms and conditions apply to the legal relationships between the person (hereinafter the Client) and the owner of the shopping environment spaahotellid.ee (hereinafter Spaahotellid epood) SPA Tours OÜ (hereinafter SPA) when purchasing products via the SPA e-shop.
1.2. In addition to these terms and conditions, the legal relationships arising from the purchasing of products through the SPA e-shop are regulated by the legislation in force in the Republic of Estonia.

2. Price
2.1 A delivery fee may be added to the price as per the delivery method selected during the ordering process.
2.2 All prices of services and products sold in the online store are in euros.

3. Placing an order
3.1 Orders can be placed on the spaahotellid.ee website as a guest.
3.2 The customer selects the desired gift cards and/or services from the e-shop and adds them to the shopping cart.
3.3 The customer fills in the information in the Checkout view and enters their e-mail address to which the gift card or voucher with a unique number will be emailed.
3.4 The customer confirms the shopping cart and pays for the services/products as per the payment environments provided by the seller. Before paying the invoice, the customer checks that the information in the invoice corresponds to his/her wishes.
3.5 After paying for the services/products, the customer must click on the “Back to the merchant” link.
3.6 Upon receipt of the order and payment, the seller sends confirmation and an invoice to the customer by e-mail.
Payment terms
4. Payment for services and products
4.1 The entire cost of the selected service/product purchased by the customer must be paid through the e-shop. By paying the fee, the customer confirms that they are familiar with and accept all the terms and conditions made available by the service provider through the e-shop.
4.2 The payment of the amount specified in the e-shop is made by transfer through Internet banking or by Visa and MasterCard debit and credit card payments.
Bank transfers are available from the following banks: Swedbank, SEB, Nordea, LHV, Krediidipank and Pocopay.
4.3 Immediately after the transfer or card payment, the customer must click the “return to merchant” button to register the payment.
4.4 Maksekeskus AS mediates the payments. Payment outside the e-shop is in a secure environment – when paying with a bank link, in the secure environment of the respective bank, and in the secure environment of Maksekeskus AS when paying by credit card. The seller does not have access to the customer’s bank and credit card data. The contract becomes valid upon receipt of the amount paid to the e-shop’s account.
4.5 The owner of the online store is the responsible processor of personal data and forwards the personal data necessary for payments to Maksekeskus AS, the authorised processor.

5. Delivery conditions
5.1 After the transfer, the purchased gift card will be sent to the customer by e-mail as a downloadable voucher.
Order cancellation and refund
6. Cancellation of order and return of products
6.1 When purchasing a gift card from the e-shop, the consumer has the right to withdraw from the sales contract within 14 days from the day of receipt of the gift card by e-mail. You cannot withdraw from the transaction if the unique code on the gift card has already been used.
6.2 When purchasing electronic gift cards from the e-shop, the gift card cannot be exchanged for cash or another service.
6.3 When purchasing electronic gift cards from the e-shop, the validity of the regular-price gift card is 12 months, unless otherwise stated.
Confidentiality and processing of personal data
7. Confidentiality and processing of personal data
7.1. The personal data (including name and surname, company name, address, telephone number, and e-mail address) provided when placing an order and making a purchase in the e-shop are confidential and are processed for the order and for sending the goods to the buyer as per the requirements of the Personal Data Act. SPA will not disclose the customer’s data to third parties without the Customer’s consent.
7.2. The owner of the online store is the responsible processor of personal data and forwards the personal data necessary for making payments to the authorised processor Maksekeskus AS.
Liability and force majeure
8. Liability and force majeure
8.1 SPA and the Client are jointly responsible for any damage caused to the other party by violating these terms and conditions in the case and to the extent provided by the legislation in force in the Republic of Estonia.
8.2 SPA is not responsible for damages caused to the Customer or for delays in product delivery if the damage or delay in product delivery is due to a circumstance that SPA could not influence, did not foresee, and could not foresee (force majeure).
Joining the SPA Club
9. Conditions for joining the SPA Club
9.1. The minimum age to join the club customer programme is 12.
9.2. The discounts applicable to the club member are personal and are not intended to be passed on to third parties unless the spa has notified additional discounts for companions or family members of the card holders.
9.3. Club member discounts are valid on the condition that the service is paid for by the service provider. Club member discounts do not apply to orders made through intermediaries.
9.4. Double discounts do not apply.
SPA is not responsible for members’ private property, possible illnesses, or accidents caused by the member’s actions or are ‘Force Majeure’.
9.5. SPA has the right to cancel the club member’s membership if:
9.5.1. the club member has given their benefits for use by third parties;
9.5.2. the club member has submitted false information in the form;
9.5.3. the club member has behaved in a disruptive manner towards other spa customers or has deliberately broken or damaged the spa fixtures or fittings.
9.5.4. SPA Club membership is based on a personal ID-code and Estonian ID-card. To get benefits, register all your purchases with an ID card, to get a discount, club membership must be proved before the service is provided!
9.5.5. The fee for the SPA Club membership is 35 €.
Other information
10. Other Terms
10.1. Disputes arising between the client and SPA regarding the ordering and purchasing of products through the SPA e-shop will be resolved through negotiations. If no agreement is reached, the Customer has the right to appeal to the Consumer Protection Board or the Tallinn City Court for the protection of their rights. Disputes and issues not specified in these terms and conditions are resolved based on the legislation in force in the Republic of Estonia
11. Final Provisions
The Estonian law applies to these ordering conditions and SPA purchase and sale agreements. If any provision of the order conditions is invalid, this does not affect the validity of the rest of the order conditions or the purchase and sale agreement. A void provision is replaced by a legal provision that is legally and economically closest to the void provision.
